Listing Agreement

This agreement is concluded between the broker publishing a listing ("Lister") and Bella International Yacht Brokerage Turizm Ticaret Limited Şirketi ("Platform") through the digital consent given at the publishing step, and forms an integral part of the User Agreement for that listing.

1. Listing Accuracy

The Lister warrants that all information, images and documents in the listing are accurate and current, that they are authorised to list the vessel, and that no third-party rights are infringed. The Platform may unpublish misleading listings.

2. Binding Nature of the Auction

The Lister accepts that the highest bid exceeding the reserve price is binding upon them; that once the reserve is met an obligation to sell arises; and that the sale will be completed with the winning bidder through the Platform.

3. Withdrawal of the Listing

ONCE THE AUCTION HAS RECEIVED A BID, the Lister may not unilaterally withdraw the listing or cancel the auction. Withdrawal is possible only if both conditions are met: (a) written approval of the Platform management, and (b) payment to the Platform of the auction cost — an amount equal to the seller's commission calculated on the highest bid at the time of withdrawal. Listings/auctions that have not yet received bids may be freely edited or removed by the Lister from the panel.

4. No Off-Platform Sales

The Lister agrees not to complete a sale with a buyer introduced through the Platform while bypassing the Platform, during or after the auction. Otherwise, a fee equal to the seller's commission on the Commission Rates page accrues for that transaction.

5. Commission and Costs

Commission rates applicable to successfully completed transactions are published on the Commission Rates page. The auction cost in this agreement is specific to the withdrawal case in Section 3 and is separate from the sale commission.

6. Effect and Disputes

This agreement is deemed concluded when the consent box at the publishing step is ticked; the time of consent is stored in Platform records and constitutes conclusive evidence. Turkish law applies; the courts and enforcement offices of Fethiye have jurisdiction.
